Subject to these Terms and Conditions (this "Agreement"), Passionned Nederland B.V. ("we", "our", "us") makes available via this website (the "Website") the BI Software Survey (the "Reports"). Your use of the Website constitutes your acknowledgment and assent to be bound by this Agreement.
Unless there is another written agreement between you and us that covers your use of part or all of the Reports, this is the entire agreement between you and us. Whenever new Reports become available, your use of them will be under this Agreement unless we notify you otherwise or another written agreement covers your use of those new reports.
We may change this Agreement at any time and you can read a current copy of this Agreement at any time by selecting the "Terms & Conditions" link. If any change is not acceptable, you must discontinue your use immediately; using the Reports after the date that this Agreement changes means you accept the changes. No change to this Agreement that is not posted on the Website is valid unless it is in writing and signed by both you and us.
Permitted Use, Limitations on Use
You may access and download purchased Reports only as required to view the Reports for your individual or company use, keeping all copyright and other notices which appear in the Reports. You may print a single copy of a purchased Report for your use. You may copy extracts from purchased Reports into your own documents, provided that all citations are attributed to "Passionned Research", and are for internal use only. You may not republish, resell or redistribute any Report, or do anything else with any Report, which is not specifically permitted in this Agreement. You may not reproduce, store in a retrieval system or transmit by any means, electronic or mechanical, any report without the prior permission of Passionned Nederland B.V.
Anti-hacking Provision
You may not, nor may you allow others to, directly or indirectly attempt to or actually disrupt, impair or interfere with, alter or modify the Website and its content.
Limitation of Liability
You are entirely liable for activities conducted by you or anyone else in connection with your use of the Reports. We take no responsibility for any incorrect information supplied to us during the research process. Quantitative and qualitive market information is based on interviews with the vendors and sometimes secondary sources whose accuracy we cannot guarantee. You acknowledge when ordering that the Reports are for your internal use and not for general publication or disclosure to third parties, unless otherwise agreed. Except as specifically stated on the Website, to the fullest extent permitted at law, neither Passionned Nederland B.V. nor any of its affiliates, directors, employees or other representatives will be liable for damages arising out of or in connection with the use of the Website or the information, content, materials or products included on the Website. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties. For the avoidance of doubt, Passionned B.V. does not limit its liability for death or personal injury to the extent only that it arises as a result of the negligence of Passionned Nederland B.V., its affiliates, directors, employees or other representatives.
Applicable Law
This Agreement will be governed by and construed in accordance with the laws of the Netherlands without giving effect to the principles of conflict of laws thereof, and to the extent permitted by applicable law, you consent to the jurisdiction of courts situated in the Netherlands in any action arising under this agreement.
Intellectual Property Rights
You acknowledge that legal and beneficial interest in Intellectual Property Rights relating to and/or developed by us in connection with the Website and the Reports belong to us. This includes all Intellectual Property Rights in any Material. You have no rights in or to the Reports and you may not use any Material other than as permitted under this Agreement. We grant you a non-exclusive, non-transferable licence to use the Intellectual Property Rights referred to above solely for the use of Material as permitted under this agreement.
The Website and the Reports remain the property of Passionned Nederland B.V. and are protected by copyright law and by international treaties. You warrant that you shall comply with all applicable laws and regulations and shall not knowingly use the Website or the Reports for any improper or unlawful purposes (including infringing any Intellectual Property Rights). No title is transferred by this license or by the payment of any fee.
Refunds Policy
Because of the nature of our BI Software Survey – containing key information and knowledge about sixteen BI software solutions which can be easily copied – we have no refund & return procedures in place. If on receipt of the guide you feel dissatisfied send us your complaints by sending an e-mail to Norman Manley and we will reply to you quickly.
